Amending Section 10.31(3)(b) of the Madison General Ordinances to update insurance requirements for privileges in streets.

DRAFTER'S ANALYSIS:  This amendment is made upon recommendation of the City Risk Manager. It clarifies ordinance language to more accurately describe the type of insurance, and proof thereof, required for a privilege in streets.

The Common Council of the City of Madison do hereby ordain as follows:
      Subdivision (b) entitled "Insurance" of Subsection (3) of Section 10.31 entitled "Privileges in Streets" of the Madison General Ordinances is amended to read as follows:
"(b)      Insurance. The applicant shall be required to furnish a Certificate of Insurance, on a form provided by the City, evidencing existence providing evidence of commercial general public liability and property damage insurance with the City of Madison, being its officers, officials, agents and employees named as an additional insureds. The insurance shall include contractual liability coverage with and minimum limits of one million dollars ($1,000,000) combined single limits per occurrence. , which coverage applicant agrees to keep in full force and effect throughout the term of the privilege in streets. The City of Madison Risk Manager reserves the right to require higher limits and other coverage terms and conditions at his/her discretion.  Applicant shall keep required insurance in full force and effect throughout the term of the privilege in streets. This insurance condition may be waived for other governmental units and in those instances where the City of Madison Risk Manager, in consultation with the City Attorney's office, determines that theis certificate requirement can be waived."
