Amending MGO Sec. 41.17 to add subsection (9) administrative extension of approval.

DRAFTER’S ANALYSIS: MGO Sec. 41.17 is amended to add subsection (9), creating an administrative extension of approval for obtaining a certificate of appropriateness. Currently, staff have no mechanism to extend the expiration of an approval for a Certificate of Appropriateness (“CoA”) granted by the Landmarks Commission. Because of the COVID-19 pandemic and supply chain challenges, contractors are booked further out and materials have significant ordering delays. Adding an administrative review will allow the Preservation Planner to extend the CoA without requiring a Landmarks Commission duplicative re-hearing. If the plans still meet the Landmarks Commission’s approval conditions, the Preservation Planner can consult with the Alderperson of the district and approve an extension of up to twelve (12) months from the expiration date. This administrative extension is based on precedent used for staff extension of conditional use approvals.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subsection (9) entitled “Administrative Extension of Approval” of Section 41.17 entitled “Obtaining a Certificate of Appropriateness” of the Madison General Ordinances is created as follows:
“41.17 OBTAINING A CERTIFICATE OF APPROPRIATENESS.
(9) Administrative Extension of Approval. Where the plans still meet the conditions of approval from the Landmarks Commission and the Certificate of Appropriateness has expired, the Preservation Planner may, after consultation with the Alderperson of the District, approve an extension of up to twelve (12) months from the expiration date.”
