Amending 10.056(4)(c), regarding the method of counting 75% of signatures of residents for purposes of a petition for certain street use permits, and clarifying which types of street closures require a petition.

DRAFTER'S ANALYSIS: Currently, for certain types of Street Use Permits, the applicant must have a petition signed by 75% of all adults residing along the street to be closed. The petition requirement only applies to street closures for small events of 1-2 blocks, on streets of 25 mph or less. The current ordinance requires the applicant and the staff to know the exact number of adults living in each household to determine whether 75% has been reached. This ordinance changes that requirement so the applicant needs the signature of just one adult from each residential dwelling or non-residential occupancy. Only those with a street address on the portion of the street to be closed are counted. Each household or non-residential occupancy gets one "vote" in order to reach 75%. The amendment also removes the word "residential" to eliminate confusion over which types of street closures require a petition. The petition will only be required for events off the Mall/Concourse, held on "local" streets - which for purposes of this ordinance, are defined as a street with a speed limit of 25 mph or slower.

The Common Council of the City of Madison do hereby ordain as follows:
Subdivision (c) entitled "Petition Required for Certain Events on Local, Residential Streets" of Subsection (4) entitled "Application" of Section 10.056 entitled "Street Use Permit" of the Madison General Ordinances is amended to read as follows:
