Approving the Town of Burke Reiner Road Special Assessments against benefited Reiner Road Properties in the City of Madison. (3rd AD)
Body
WHEREAS Wis. Stat. Sec. 66.0703 grants Towns the authority to specially assess properties for special benefits conferred upon properties by a street improvement; and
WHEREAS the Town of Burke plans to reconstruct Reiner Road from approximately 2500’ south of Burke Rd to approximately 2000’ north of Nelson Rd in 2023 (the “Project”). On May 17, 2023, the Town approved Town Resolution 05172023B, which allows the Project and levies special assessments against benefited Reiner Road parcels; and
WHEREAS, under Wis. Stat. Sec. 66.0707(1), in order for the Town of Burke to specially assess properties in the City of Madison that are benefited by a Town project, the owner of the property must be entitled to the use of the work or improvement on which the assessment is based on the same conditions as the owner of property within the Town, and the City of Madison must approve the levy of the special assessment by resolution; and
WHEREAS 2801 Reiner Road is the lone City of Madison parcel that will be benefited by the Project; and
WHEREAS City of Madison Engineering Division staff has reviewed the plans and specifications for the Project, and the preliminary schedule of assessments for the Project, and determined that the owner of 2801 Reiner Road will be entitled to the use of the Project improvements on the same conditions as Town property owners.
NOW THEREFORE BE IT HEREBY RESOLVED that, pursuant to Wis. Stat. Sec. 66.0707(1), the City of Madison approves the levy made by the Town of Burke against 2801 Reiner Road for the Project in Town of Burke Resolution No. 05172023B, provided that the owner will be entitled to the use of the Project improvements on the same conditions as Town property owners.
