Amending Section 9.13(6)(j)1.a. of the Madison General Ordinances to allow Merchant Vendors to display merchandise on the sidewalks on certain federal holidays.

DRAFTER'S ANALYSIS: This ordinance would allow merchants with a "Merchant Vending License" to display merchandise for sale on sidewalks on the State Street Mall / Capitol Concourse on federal holidays. Currently, these merchants may only put out merchandise on Thursdays and weekends and certain special events.

The Common Council of the City of Madison do hereby ordain as follows:

1. Subparagraph a. of Paragraph 1. entitled "Miscellaneous Restrictions on Merchant Vendors" of Subdivision (j) entitled "Miscellaneous Restrictions on Merchant Vendors and Sidewalk Cafes" of Subsection (6) entitled "Regulations and Procedures for Vending on the State Street Mall/Capitol Concourse" of Section 9.13 entitled "License for Selling on Public Streets" of the Madison General Ordinances is amended to read as follows:

"a. Merchandise may only be displayed during normal business hours on Thursdays, Fridays, Saturdays, and Sundays, and the following federal public holidays established under 5 U.S.C. ยง 6103 (New Year's Day, Washington's Birthday, Martin Luther King Jr.'s Birthday, Memorial Day, Independence, Labor Day, Columbus Day, Veteran's Day, Thanksgiving Day, Christmas Day); with the following exceptions: merchant vendors on portions of King Street within the Mall/Concourse may display merchandise only on Thursdays, Fridays and Saturdays; and all Mall/Concourse merchant vendors may display merchandise on other days, if approved by the Vending Oversight Committee (VOC) in conjunction with a special event for which a street use permit has been granted, upon the VOC's determination that such merchant vending will not interfere with the events and will enhance the public u...
