Approving Addendum No. 1 to Target at Hilldale, Contract No. 2247. (11th AD)
Body
WHEREAS, on July 29, 2010, the developer, HD Annex LLC, a Wisconsin limited liability company of Chicago, Illinois, hereinafter the "Developer" had entered into a Contract For the Construction of Public Improvements that will be accepted by the City of Madison with the City of Madison, and;
WHEREAS, the City of Madison and the Developer has mutually agreed to modify the existing Contract For the Construction of Public Improvements that will be accepted by the City of Madison to remove work that shall be assumed under another Contract, and;
WHEREAS, the Contract For the Construction of Public Improvements that will be accepted by the City of Madison for 4620 Frey Street PUD, Contract No. 2961 shall assume the work removed from Contract No. 2247 by Addendum No. 1, and;
WHEREAS, said Contract For the Construction of Public Improvements that will be accepted by the City of Madison for 4620 Frey Street PUD, Contract No. 2961 shall be in place prior to the acceptance of Addendum No. 1, Contract No. 2247.
NOW, THEREFORE, BE IT RESOLVED, That the Mayor and City Clerk are hereby authorized and directed to execute Addendum No. 1 for Target at Hilldale, Contract No. 2247, with HD Annex LLC, a Wisconsin limited liability company.
