The Board of Public Works and the City Engineer having made reports of all proceedings in relation to the improvement of Resurfacing 2010 - Curb & Gutter Assessment District pursuant to a resolution of the Common Council, RES-09-00987, ID No. 16572, adopted 12/08/2009, which resolution was adopted thereto, and the provisions of the Madison General Ordinances and the Wisconsin Statutes in such case made and provided, and the Common Council being fully advised.
The City Engineer plans to introduce two resolutions and award multiple contracts in 2010 for the Resurfacing Program. This resolution for assessable projects includes Resurfacing 2010 - Curb & Gutter Assessment District. Also included with these projects are pavement milling, paving and storm sewer construction.
A separate resolution includes contracts for: Asphalt Paving; Asphalt Grinding and Milling; and Asphalt Base Patching and Base Patch Grinding
The following parcels are located in the Town of Middleton. Section 14.02 of the Final City of Madison and Town of Middleton Cooperative Plan Under Section 66.0307, Wisconsin Statutes, Dated September 29, 2003 is attached and included as part of this Schedule of Assessments.

BE IT RESOLVED:
1. That the City at large is justly chargeable with and shall pay the sum of $6,030,325.00 of the entire cost of said improvement.
2. That for those eligible property owners requesting construction of a rain garden in the public right-of-way adjacent to their property shall execute the necessary waiver of special assessments on forms provided by the City Engineer;
3. That the sum assigned to each separate parcel, as indicated on the attached schedule of assessment, is hereby specially assessed upon each such parcel.
