Authorizing the Mayor and City Clerk to execute an agreement with the State of Wisconsin Department of Transportation for Maintenance of the South Dutch Mill Road to Collins Bicycle/Pedestrian Path.

PREAMBLE
The South Dutch Mill Road to Collins Bicycle/Pedestrian Path will provide a safe route for bicycles and pedestrians parallel to Stoughton Road (USH 51) through the interchange with USH 12/18 (Beltline Highway). This path will be constructed by the State of Wisconsin Department of Transportation (WisDOT) at no expense to the City of Madison. The path lies almost entirely within WisDOT right of way for Stoughton Road.
WisDOT agrees to allow the path to occupy their right of way, and to resurface or replace the pavement as needed in the future with the understanding that the City would assume responsibility for routine maintenance of the path corridor, including mowing a width approximately 6 feet either side of the paved path and winter snow removal at the discretion of the City. WisDOT retains responsibility for any fencing and authority for permitting of utilities as well as all other property interests within their right of way.
NOW THEREFORE BE IT RESOLVED
That the Mayor and City Clerk are hereby authorized to execute an agreement with the State of Wisconsin Department of Transportation for maintenance of the South Dutch Mill Road to Collins Bicycle/Pedestrian Path.
