Body
WHEREAS, on August 28, 2003, the Developer, Habitat For Humanity of Dane County, Inc., entered into a Contract For Subdivision Improvements with the City for Twin Oak Subdivision, and,
 
WHEREAS, Section 16.23(9)(d)(6)(d), MGO requires the City to reimburse the Developer up to the statutory limit, or install the street improvements, adjacent to the lands owned by the City in the Developers subdivision, and,
 
WHEREAS, the Developer has completed the installation of street improvements, excluding the bituminous surface course, on the streets in said subdivision, and,  
 
WHEREAS, the amount of street improvements subject to the City's ordinance in said subdivision, exceeds the statutory limit for reimbursement, and,
 
WHEREAS, the City and the Developer have agreed that the City shall compensate the Developer by installing the bituminous surface course on certain streets in said subdivision, equivalent to the value of the completed street improvements adjacent to City-owned lands, as part of a future public works contract.  
 
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are hereby authorized to execute Addendum No. 1 to the Contract For Subdivision Improvements for Twin Oaks Subdivision, Contract No. 1930, with Habitat For Humanity of Dane County, Inc.
