Fiscal Note
As per State Statutes, beginning in 2009, the City will make annual payments for five years of an estimated $17.93 to the Town of Blooming Grove (an amount equal to the town levy on the parcel for the year 2007). The payments will come from the General Fund Miscellaneous account and will be accommodated in future budgets.

Authorizing the Mayor and City Clerk to sign an Attachment Agreement between Suter's Speed Shop, Inc., and the City of Madison ("City").
Body
WHEREAS, pursuant to the Town of Blooming Grove and City of Madison Cooperative Plan ("Plan"), the City of Madison approves development in the Town of Blooming Grove; and
WHEREAS, the City of Madison may, at its discretion, require attachment to the City as part of development approval; and
WHEREAS, Suter's Speed Shop, Inc., owns land ("Property") in the Town of Blooming Grove that it wishes to develop; and
WHEREAS, the City of Madison desires attachment of the Property, but not until municipal services are available.
NOW, THEREFORE, BE IT RESOLVED, the City and Suter's Speed Shop, Inc., shall enter into this Attachment Agreement whereby:
1. Suter's Speed Shop, Inc., shall petition for attachment to the City within ninety (90) days after municipal services become available to the site.
2. Following attachment, Suter's Speed Shop, Inc., shall hook up to municipal services pursuant to City ordinances and policies in effect at the time of attachment.
3. This Agreement shall run with the land, be recorded in the Office of the Dane County Register of Deeds and shall be binding on Suter's Speed Shop, Inc., as well as any successors, assigns, heirs, or any other person taking any interest or right in the property after the date on which the Agreement is signed.
BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to execute this Agreement.
