Funds are included in the 2005 Metro Operating Budget. The Miller Brewing Co. donation is $10,000. No impact on the cost controls. The city is covered under its current insurance policies. Therefore, the resolution will not result in increased premiums at this time.

Accepting sponsorship of Miller Brewing Company for the provision of free expanded transit service on New Year's Eve, and authorizing the Mayor and Clerk to sign an agreement with Miller Brewing Company, which may contain an indemnification clause.
Body
WHEREAS Metro has provided free, expanded transit service on New Year's Eve for the past 30 years, beginning with grant resources from state Highway Safety funds; and
WHEREAS since the state stopped providing Highway Safety funding for this service, Metro transit has solicited sponsors from the community; and
WHEREAS Miller Brewing Company sponsors a Miller Free Rides Program in Milwaukee and other urban areas across the country and has sponsored Metro's program the past ten years; and
WHEREAS Miller's proposal contains a provision which requires the City to hold harmless, indemnify and defend against liability, damage, claims or suits which arise out of the City's acts or omissions in connection with the agreement; and
WHEREAS pursuant to APM 1-1, the inclusion of such a provision requires the express approval of the Common Council; and
WHEREAS the provision of expanded service on New Year's Eve is designed to provide better service to our community and cannot be provided without this sponsorship such that the execution of the agreement is in the public interest;
NOW THEREFORE BE IT RESOLVED that the Common Council accepts the sponsorship of Miller Brewing Company and funding for the provision of free expanded service on New Year's Eve in 2005;
