Title

Approving a maintenance agreement for privately maintained improvements within the public right of way.  (6^th AD)

Body

WHEREAS, the property owner of 220 Merry Street, Karolyn Beebe, has requested to have a pervious concrete driveway apron installed with Engineering Project Number 53W0953, Contract No. 6420, and,

WHEREAS, Karolyn Beebe was required to enter into a maintenance agreement with the City for said improvements of way to insure that the driveway apron is properly maintained and that any public infrastructure damaged as result of the pervious concrete apron is properly repaired.

NOW, THEREFORE, BE IT RESOLVED:

1.      That the Mayor and City Clerk are hereby authorized and directed to execute an agreement between The City of Madison and Karolyn Beebe, property owner of 220 Merry Street for the maintenance of portions of the public right of way Merry Street.

2.      The Common Council is approved to accept ownership of the improvements in the Maintenance Area if a maintenance agreement is executed and recorded.
