The cost of this wetland credit acquisition is $110,000 and will be charged to Acct. No. ESTM-54809-810384-00-53B0322. Debt service associated with this additional general obligation borrowing will be paid by future year Stormwater Utility Fees.

PREAMBLE

Mitigation, for the filling of 3.9 acres of wetland, associated with construction of the Nesbitt Road Regional Retention Basin (discharge point of the Upper Badger Mill Creek to the Town/City of Verona) was a condition of both the USACOE and WDNR permits for construction of the project. The purchase of these wetland credits has been allowed as a modified condition of both the WDNR/USACOE permits. Originally, the wetland mitigation for this project was completed on site. City Engineering has planted the project in accord with the original permit requirement twice in the last two (2) years. Both of these planting efforts have failed. Based on the results of these efforts Engineering staff has persuaded the regulatory agencies to allow the purchase of credits to meet our mitigation requirement

WHEREAS, the City of Madison has previously constructed the Nesbitt Road Regional Retention Basin; and

WHEREAS, one of the WDNR & USACOE permit conditions for construction of the basin was mitigation of the wetland impacts of the project; and

WHEREAS, the City has previously attempted two (2) wetland plantings on the site to meet the conditions of the permit; and

WHEREAS, both of the previous planting efforts have resulted in a planting with over 70% mortality; and

WHEREAS, based on this prior work the USACOE and WDNR have agreed to allow the City to purchase mitigation credits to satisfy their requirement; and
