The Board of Public Works, having heard an appeal, under Madison General Ordinances Secs. 37.05(4)(c), (d) and (e) and Sec. 37.13(1), on Oct. 6, 2021 and December 16, 2021, of the City Engineer’s determination regarding the total area, impervious area and pervious area measurements of the parcels located at 7646, 7704 and 7802 E. Buckeye Road, as well as of the City Engineer’s final determination regarding the application of the City’s Rate Adjustment and Credit Policy to these parcels, which determination was updated during the pendency of this appeal based upon additional information submitted by the Appellant, and after considering the testimony, documents and arguments offered by the parties, the Board does hereby affirm the determinations of the City Engineer regarding the measurements and application of the Rate Adjustment and Credit Policy to these parcels.
