A RESOLUTION to petition the State of Wisconsin Commissioner of Railroads to make a determination on the construction of two new shared-use path crossings of the rail corridor for Cannonball Path: Phase 6 and make a determination of the crossing protection required. (District 14)

Body

City Engineering is planning for the construction of the Cannonball Path: Phase 6 project from Fish Hatchery Rd to the Wingra Creek Bike Path, completing the Cannonball Path corridor. The project will require the construction of an at-grade railroad crossing at the intersection of the planned Cannonball Path and the Madison Newspaper Railroad Spur corridor. In addition, the project is looking to add a connector path for access to and from Ridgewood Way, which will require another at-grade railroad crossing at the intersection of the connector path and the Wisconsin Department of Transportation railroad corridor. The improvements at both of these locations are in the interest of public safety, accessibility, and in line with the long-term planning for the South Madison area.

 

State Statutes 195.28 and 195.29 pertaining to railroad / highway crossings and their protection require the City to petition the State of Wisconsin Office of Commissioner of Railroads to investigate, hold a public hearing and make a determination in these matters regarding public convenience and safety, 

 

NOW, THEREFORE BE IT RESOLVED that the Mayor and City Engineer are hereby authorized to petition the State of Wisconsin Commissioner of Railroads to make a determination on construction of two new shared-use path crossings of the rail corridors at the Cannonball Path: Phase 6 and make a determination of the crossing protection required;

 

BE IT FURTHER RESOLVED that the Mayor shall authorize the City Attorney or other City staff as may be necessary to present the City’s interests at any hearing before the Commissioner of Railroads.
