Approving removal of existing street trees and installation of public improvements necessary for the development located at 2402 Darwin Road. (District 18)

Body

WHEREAS, the developer, Dane County Regional Airport, has completed the required coordination with City Forestry for an airport parking lot expansion at 2402 Darwin Road and 3108 International Lane (permitted use site plan review LNDSPR-2026-00116), and,

 

WHEREAS, construction constraints and health of trees will require the removal of seven existing street trees, and,

 

WHEREAS, Board of Public Works approval is required prior to City Forestry issuing a Tree Removal Permit, and,

 

WHEREAS, Section 16.23(7) of the Madison General Ordinances and the site plan review stipulations require the developer to apply for an Excavate in the Right of Way permit and install the public improvements necessary to serve the project.

 

NOW, THEREFORE, BE IT RESOLVED:

 

1.                     That City Forestry is hereby authorized to issue the Tree Removal Permit required for construction at 2402 Darwin Road.

 

2.                     That the developer, Dane County Regional Airport, is authorized to construct the public improvements with an Excavate in the Right of Way permit in accordance with the requirements for LNDSPR-2026-00116 and as approved by the City Engineer at the sole cost of the developer, except as follows: NONE

 

3.                     That the Mayor and City Clerk are hereby authorized to sign and grant easements or right-of-way release or procurement documents, maintenance agreements or encroachment agreements, as necessary and grant or accept dedication of lands and/or easements from/to the Developer/Owner for public improvements located outside of existing public fee title or easement right-of-ways.

 

4.                     The Common Council is approved to accept ownership of the improvements in the Maintenance Area if a maintenance agreement is executed and recorded as a condition of LNDSPR-2026-00116.
