DRAFTER’S ANALYSIS: This ordinance adopts a recent change in state statute that exempts an owner of a dog that is considered a service animal under Wis. Stat. Sec. 106.52(1)(fm) from paying the dog license tax.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subdivision (1) of Section 9.50 entitled “Dog License Required” of the Madison General Ordinances is amended as follows:
“(1) Any person who owns, harbors or keeps a dog in the City of Madison more than five (5) months of age on January 1 of any year or five (5) months of age within the license year shall annually, on or before the date the dog becomes five (5) months of age pay the dog license tax and obtain a license. The owner of a dog that is a service animal as defined by Wis. Stat. Sec. 106.52(1)(fm), is exempt from paying the dog license tax for said dog. The license year commences on January 1 and ends on the following December 31.”
