DRAFTER'S ANALYSIS: The current public passenger vehicle ordinance prohibits a company from transferring a license to new owners in Sec. 11.06(4)(g). This amendment would allow the Transportation Commission to approve an exception to the transferability subsection of the ordinance after the licensee makes a written request to the City Traffic Engineer who makes a recommendation to the Transportation Commission. It is expected that this amendment would allow public passenger vehicle companies to request an exception to transfer a license if they are restructuring the legal ownership of their company but maintaining substantially similar service and operations in a way that is not contrary to the public interest.

The Common Council of the City of Madison do hereby ordain as follows:

Subdivision (g) entitled “License Not Transferable” of Subsection (4) entitled “Licensing of Public Passenger Services” of Section 11.06 entitled “Licensing and Regulating Public Passenger Vehicles, For Hire” of the Madison General Ordinances is amended to read as follows:

“(g) License Not Transferable. No license to engage in the business of transporting passengers for hire issued pursuant to this Subsection shall be transferable unless the Transportation Commission approves an exception. A licensee may submit a written request to the City Traffic Engineer asking to transfer the license. The City Traffic Engineer, in making a recommendation, and the Transportation Commission, in granting or denying the licensee’s request, may consider whether the current license is in good standing, whether the change in ownership will provide substantially similar service and operation, and whether the request is ...
