Title

Accepting title to three vacant lots in the Third Addition to Cherokee Park from Cherokee Park, Inc. and, in exchange, authorizing the release of the open space easements in Outlot 1 of CSM 12991.

Body

The City Parks Division staff has long advocated that the City should acquire ownership of three vacant, platted lots (Lots 179, 180, and 181) in the Third Addition to Cherokee Park plat. The lots are low, wet and not buildable. Each of the three lots abuts the City's existing Cherokee Park lands on Burning Wood Way. All three lots are owned by Cherokee Park, Inc., and the corporation has agreed to convey the lots to the City, at no cost, in exchange for the City's release of the open space easements that cover Outlot 1 of CSM No. 12991.

NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Madison authorizes the acceptance of ownership of the fee simple interest in Lots 179, 180 and 181 in the Third Addition to Cherokee Park in exchange for the City's partial release of the open space easements that cover Outlot 1 of Certified Survey Map No. 12991.

BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to execute, deliver, accept and record any and all documents and take such actions as shall be necessary or desirable to accomplish the purpose of this resolution in a form approved by the City Attorney.
