The proposed resolution authorizes acceptance of a Permanent Limited Easement for public sidewalk purposes. No City appropriation is required.

Accepting a Public Sidewalk Easement from Redan Green, LLC across property located at 1435 E. Main Street.
Body
WHEREAS, the Redan Green, LLC, (the “Owner”) is the owner of the property located at 1435 E. Main Street, City of Madison, Wisconsin (the “Owner’s Property”); and
WHEREAS, sidewalk improvements exist on the Owner’s Property without the benefit of an easement; and
WHEREAS, the Owner desires to grant, at no cost to the City, and the City desires to accept, a Permanent Limited Easement for Public Sidewalk Purposes in that portion of the Owner's Property more particularly described below and depicted on attached Exhibit A (the “Easement Area”).
NOW, THEREFORE, the Owner hereby grants to and for the benefit of the City a non-exclusive Permanent Limited Easement for Public Sidewalk Purposes in the Easement Area.
Easement Description
Part of Lot 10 and Lot 13, Fox’s Replat of a Part of Blocks 225 & 239 of the Original Plat of Madison, recorded as Document No. 269440, Dane County Registry, in the City of Madison, Dane County, Wisconsin, more particularly described as follows:
Beginning at the northerly corner of said Lot 10; thence S 44°40'51'' E along the southwesterly right of way line of Northern Court, 98.24 feet to a point of curvature; thence along the right of way of said Northern Court and the arc of a curve concaved southwesterly, having a radius of 55.00 feet and a long chord bearing S 16°08'06'' E, 52.00 feet; thence S 45°02'31'' W along the northwesterly right of way line of Northern Court, 14.87 feet to the most southerly corner of said Lot 13; thence N 44°45'51'' W, 1.00 feet; thence N 45°39'01'' E, 6.29 feet; thence N 12°31'05'' E, 15.35 feet; thence N 00°24'45'' E, 10.66 feet; thence 12°50'09'' W, 12.03 feet; thence N 23°33'28'' W, 12.21 feet; thence N 35°09'48'' W, 7.44 feet; ...
