DRAFTER'S ANALYSIS:  Amending the ordinance to raise service of process fees from $30 to $40, fees for serving an execution of judgment from $30 to $40 and the mileage rate from 24 cents to 37 cents a mile; to be consistent with the rate imposed by the County.

The Common Council of the City of Madison do hereby ordain as follows:
 
Section 9.48 entitled "Fees for Service of Process" of the Madison General Ordinances is amended to read as follows:
 
"9.48      FEES FOR SERVICE OF PROCESS. Pursuant to Secs. 814.70 and 814.705, Wis. Stats., the city police shall collect the fees under this section as follows:
(1)      Service of Process. For each service or attempted service of a summons or any other process for commencement of an action, a writ, an order of injunction, a subpoena or any other order, thirty forty dollars ($3040) for each defendant or person. If there is more than one defendant or person to be served at a given address, thirty forty dollars ($3040) for each additional defendant or person.
(2)      Execution on Judgment. For serving an execution on a judgment demanding payment thereof or other writ not provided for, thirty forty dollars ($3040).
(3)      Travel. For travel in serving any summons, writ or other process, twenty-nine thirty-seven cents ($.2937) for each mile actually and necessarily traveled."
