Fiscal Note
The proposed resolution authorizes an agreement with Dahl Family LLC for connection of its Town of Middleton property to City of Madison water utility facilities. No appropriation is required to enter into this agreement. The property owner will be responsible for all costs related to the connection of his property to the City’s water utility facilities, which are adjacent to the subject property.
Body
WHEREAS Sections 10 and 14.03 of the Final City of Madison and Town of Middleton Cooperative Plan dated September 29, 2003 (the “Plan”) pursuant to Wis. Stat. §66.0307 permit a property owner in the Town to request connection to City sewer and/or water services prior to attaching the property to the City, provided that the owner agrees to pay for extension of the sewer and/or water services over a five-year period with interest, and the owner agrees to attachment to City at the end of the five-year period; and,
WHEREAS, Dahl Family LLC, the Owner of real property located at 3276 High Point Road in the Town of Middleton (hereinafter referred to as “the Property”), wishes to formally connect the existing Commercial Facility to City of Madison water utility facilities currently located in High Point Road; and,
WHEREAS, the Owner has already paid water utility connection charges and is agreeable to entering into an attachment agreement with the City under which the Owner will agree to attach the Property to the City within five years of connecting to City water services.
NOW THEREFORE BE IT RESOLVED the Mayor and City Clerk are hereby authorized to sign an Attachment Agreement for the Property, on a form approved by the City Attorney, under which the Property will be attached to the City within five yea...
