Fiscal Note
The 2016 Adopted Budget reflected a $15 increase in the City’s towing from the current rate of $50. The City’s towing costs increased in October 2015 due to a newly negotiated contract. This fee was last increased in 1997. The new rate will increase general fund revenues by $150,000.

Amending Sections 12.1331(3) and 1.08(3)(a) of the Madison General Ordinances to modify the towing charge forfeiture and the bail deposit for violation of said violation.

DRAFTER'S ANALYSIS: This ordinance increases the towing charge forfeiture which has not been increased since adopted in 1997. These fees coincide with the revenues adopted in the 2016 adopted operating budget.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subsection (3) entitled “Towing Charge Forfeiture” of Section 12.1331 entitled “Vehicle Towaway” of the Madison General Ordinances is amended to read as follows:
“(3) Towing Charge Forfeiture. Pursuant to its authority under Wis. Stat. §§ 349.13(3), 349.13(3m), 342.40(3), and 341.65(2), the City of Madison hereby establishes a towing charge forfeiture. Whenever a vehicle is lawfully towed by or at the direction of the police or fire department, the owner or operator of the towed vehicle shall forfeit sixty-five dollars ($50.0065). This forfeiture shall be in addition to any other charges which may be lawfully charged to the owner or operator of the vehicle for the cost of removal, impounding, immobilization, storage or disposal of said vehicle.”
2. Subdivision (a) of Subsection (3) entitled “Schedule of Deposits” of Section 1.08 entitled “Issuance of Citations for Violations of Certain Ordinances and Providing a Schedule of Cash Deposits” of the Madison General Ordinances is amended by amending therein the following:
