Fiscal Note

The proposed ordinance would be enforced by Building Inspection. The agency anticipates it will be able to absorb the additional duties of enforcement with existing staff. No additional City appropriation is required.

Creating Section 32.11(10) of the Madison General Ordinances relating to prohibiting a rental agreement from requiring that a cat be declawed in order to be permitted as a pet in a rental property.

DRAFTER’S ANALYSIS:    This proposal would prohibit a landlord from requiring that a tenant have a cat declawed as a condition of a lease. A landlord could still refuse to allow cats to be permitted as pets in a rental property.

The Common Council of the City of Madison do hereby ordain as follows:

 

                     1.                     Subsection (10) of Chapter 32.11 entitled “Prohibited Rental Agreement Provisions” of the Madison General Ordinances is hereby created as follows:

 

(10) Require that a cat be declawed in order to be permitted as a pet on the premises.
