Preamble
The City Engineering 2006 Capital Budget provides for construction of a pedestrian / bicycle path, referred to as the Yahara River Parkway Path, in the location of existing South Thornton Avenue between East Main Street and Williamson Street. The City of Madison by Resolution # 03791 has approved plans and specifications and authorized advertising for bids for this project to remove the existing roadway at the railroad crossing and install a new non-motorized path crossing.
This project is consistent with the adopted Bicycle Transportation Plan for Madison and Dane County, and with the Yahara River Parkway and Environs Master Plan adopted in June of 1998. The improvement at this location is in the interest of public safety and convenience.
State Statutes 195.28 and 195.29 pertaining to railroad / highway crossings and their protection require the City to petition the State of Wisconsin Office of Commissioner of Railroads to investigate, hold a public hearing and make a determination in these matters regarding public convenience and safety,
NOW, THEREFORE BE IT RESOLVED that the Mayor and City Clerk are hereby authorized to petition the State of Wisconsin Commissioner of Railroads to make a determination to modify the existing roadway crossing of the rail corridor at South Thornton Avenue between East Main Street and Williamson Street to provide a public pedestrian / bicycle crossing in place of the existing vehicular crossing, and also a determination of the crossing protection required;
