Amending Section 39.02(9)(a)2.i. of the Madison General Ordinances to clarify an exemption for self-governed nations, tribes, and communities of Indigenous peoples.

Body

DRAFTER’S ANALYSIS:    Section 39.02(9) requires certain contract language when the City spends $50,000 or more annually with a contractor. Federal, state and local governments are exempt from these requirements. Indigenous nations or tribes that are self-governed sovereign entities are similar to other exempt governmental entities for purposes of making contracts with the City. This amendment makes that exemption explicit.

The Common Council of the City of Madison do hereby ordain as follows:

 

                     1.                     Subparagraph i. of Paragraph 2. entitled “Contract” of Subdivision (a) entitled “Definitions” of Subsection (9) entitled “Contract Compliance Provisions” of Section 39.02 entitled “Affirmative Action Ordinance” of the Madison General Ordinances is amended as follows:

 

“i.                     Contracts with the United States of America and individual agencies of the U.S. government, and contracts with a state recognized or federally recognized tribe, band, nation, pueblo, village, or similar sovereign community; or other self-governed community of Indigenous peoples with the capacity to contract in a government-to-government relationship.”
