Title
Approving a maintenance agreement for privately maintained improvements within the public right of way of N Frances Street adjacent to UW Kohl Center - Hall of Fame Plaza. (District 4)
Body
WHEREAS, the Board of Regents of the University of Wisconsin System (the “University”), made and application for a Minor Alteration to an approved Planned Unit Development to convert portion of lawn space to outdoor open-air hall of fame plaza along with other amenities to the University of Wisconsin Kohl Center at 601 W Dayton Street; and.
WHEREAS, City Agencies have reviewed the proposed Minor alteration under LNDMAP-2026-00015 and provided conditions of approval to be satisfied prior to final approval of the Minor Alteration; and,
WHEREAS, as part of the development, the University has proposed to construct certain public improvements in the public right-of-way of University Avenue including planting beds, landscape plantings, and street trees, which improvements were approved by the City per LNDMAP-2026-00015. The proposed improvements described on Exhibit A and shown on Exhibit B, attached hereto and made part of this resolution; and,
WHEREAS, the University shall construct the public improvements upon applying for and receiving any required permits for work within a public right-of-way from the City of Madison Engineering Division; and
WHEREAS, per the conditions of approval for the Minor Alteration per LNDMAP-2026-00015, the said approved public improvements in the public right-of-way shall be maintained by the University.
NOW, THEREFORE, BE IT RESOLVED:
1. That the Mayor and City Clerk are hereby authorized and directed to execute a Maintenance Agreement with the University for the maintenance by the University of certain public improvements, per attached Exhibits A and B, adjacent to UW Kohl Center - Hall of Fame Plaza at 601 W Dayton Street.
