Fiscal Note
Under the terms of the proposed agreement, the National Conference of Bar Examiners would pay to the City a payment for municipal services estimated at approximately $31,000 per year. The first payment would be for the year 2007 and payable in January of 2008. The annual payment would be indexed for inflation and would remain in effect as long as the subject property is exempt from property tax.

WHEREAS, on May 2, 2006, the Common Council adopted Ordinance File No. 03142 rezoning property at 601 West Wilson Street from PUD (GDP) to Amended PUD (GDP) and from Amended PUD(GDP) to Amended PUD(SIP) to allow construction of a four (4) story, approximately 45,000 sq. ft. commercial building; and
WHEREAS, the above rezoning was conditioned on signing an Agreement with the City relating to a payment for municipal services;
NOW, THERFORE, BE IT RESOLVED that the Common Council of the City of Madison hereby authorizes the Mayor and City Clerk to sign an Agreement with National Conference of Bar Examiners (NCBE), the owner of the property at 601 West Wilson Street, on the following terms and conditions:
1. In recognition of the value of municipal services provided to NCBE and in further recognition of the economic impact the provision of such services has on the City, NCBE shall make an annual payment for municipal services (PMS) to the City.
2. The annual PMS shall be based on the value of the building(land and construction costs), the City's 2007 mil rate and a fixed percentage of the City's budget (45%), which represents public safety costs. The fee shall be increased annually based on a percentage representing the most recent Consumer Price Index for All Urban Consumers.
3. The Agreement for PMS shall terminate if:
