Body
WHEREAS, Owners have applied for and received a demolition permit-conditional use to remove an exisitng house and garage and construct a new house and garage at 5116 Spring Court; and

WHEREAS, a condition of the demolition permit-conditional use is the granting of an easement for sanitary sewer purposes to the City of Madison, along with provisions for a skywalk from the second floor of the garage to the second floor of the house within the easement area; and

WHEREAS, the Owners have offered said Sanitary Sewer Easement containing provisions for the skywalk to the City of Madison at no cost; and

WHEREAS, City of Madison Engineering Division staff have reviewed and recommend the acceptance of the Sanitary Sewer Easement containing provisions for the second floor skywalk.

NOW, THEREFORE, BE IT RESOLVED that the City of Madison is hereby authorized to accept from the Owners, Jason and Lori Smith, at no cost to the City of Madison, a 20-foot wide Sanitary Sewer Easement across the following described lands (the "Easement Area"):

Part of the Southeasterly 35.00 feet of Lot 31 and the Northwesterly 15.00 feet of Lot 32, Block One, Spring Harbor, City of Madison, Dane County, Wisconsin, described as follows:

Commencing at the Southwestern corner of the above described parcel; thence along the Westerly line of said parcel N21?30'00", 85.59 feet to the point of beginning; thence continuing along said Westerly line N21?30'00", 20.09 feet; thence S73?50'01"E, 47.37 feet to a point on the Easterly line of said parcel; thence along said Easterly line S22?51'31"W, 20.14 feet; thence N73?50'01"W, 46.89 feet to the point of beginning.
