Amending Section 23.40(8) of the Madison General Ordinances to change the period when oak trees may not be removed, trimmed or pruned.

DRAFTER'S ANALYSIS:  This proposal provides that oak trees may not be removed, trimmed or pruned after April 1 and before October 15 of each year.  Currently such work may occur until April 15 of each year.

The Common Council of the City of Madison do hereby ordain as follows:

      Subsection (8) entitled "Removal or Pruning of Oak Trees Prohibited" of Section 23.40 entitled "Elm Trees Infected with Dutch Elm Disease or Oak Trees Infected with Oak Wilt Disease a Nuisance" is amended to read as follows:

"(8)      Removal or Pruning of Oak Trees Prohibited. No person, firm or corporation shall remove, trim or prune any oak tree or portion thereof between April 15April 1 and October 15 without first securing the written permission of the City Forester, or designee."
