The proposed resolution authorizes an annexation petition to annex greenway property owned by the City of Madison but currently within the Town of Verona. No City appropriation is required.

Authorizing the Mayor and City Clerk to execute an annexation petition to cause a 15-foot wide strip of a City-owned greenway not located in the City to be annexed from the Town of Verona concurrent with the annexation of the Schmitt property to the City from the Town of Verona.
Body
WHEREAS the City of Madison owns a 15-foot wide, approximately two-acre strip of land generally bounded by Cross Country Road on the south, a greenway dedicated to the public as Outlot 10 of the Nesbitt Valley subdivision on the east, the easterly, rear lot lines of various residential lots platted with the First Addition to Nesbitt Valley subdivision along the east side of Ambleside Drive on the west, and to the north, an approximately 34.5-acre undeveloped agricultural property located in the Town with frontage on Maple Grove Drive and generally known as the “Schmitt Farm,” said bounded strip of City-owned land hereinafter referred to as “the property”; and
WHEREAS the property was conveyed to the City of Madison by Warranty Deed as Document No. 3397929 on November 8, 2001, and is maintained by the City Engineering Division as part of the adjacent stormwater greenway; and
WHEREAS Section 66.0221(1), Wis. Stats. generally prohibits a city or village from creating by annexation a town area which is completely surrounded by the city or village (also known as creating a “town island”); and
WHEREAS the property was not annexed to the City when the adjacent 43.92 acres of land to the west and east that became the Nesbitt Valley subdivisions were annexed by the Common Council by Ordinance No. 12636 (ID 27699) on July 11, 2000; and
WHEREAS the owners of the Schmitt Farm have initiated a process to annex their 34.5-acre property into the City; and
