The total $1,000,000 budgeted for the Contingent Reserve is available for this $200,000 appropriation. This appropriation would have no impact on the levy or State Expenditure Restraint Program limits. Prior years' appropriations for this litigation were $30,000 in 2003 and $50,000 in 2004; there is a current balance of $1,710.

Authorizing an additional appropriation for Attorney Robert Horowitz and the firm of Stafford Rosenbaum, LLP for the American Family tax litigation.
Body
WHEREAS, the City has retained Attorney Robert Horowitz and the firm of Stafford Rosenbaum as outside counsel for the American Family property tax litigation; and
WHEREAS, funds appropriated for the such litigation in calendar 2004 have been exhausted; and
WHEREAS, the City Attorney estimates that additional funds to carry the case through a trial will total approximately $200,000.
NOW, THEREFORE, BE IT RESOLVED that an additional appropriation of $200,000 is made from the contingent reserve to the Miscellaneous Litigation account for payment of legal expenses to Robert Horowitz and the Staffford Rosenbaum law firm for the American Family property tax litigation.
