Fiscal Note
The proposed resolution authorizes addendum number one to Contract #9088 for 575 Zor Shrine Place which adds a section for off-site sanitary sewer upgrades at an estimated cost not to exceed $25,000. Contract #9088 was approved via RES-22-00434 (Legistar #71653) on June 7, 2022 as a private contract which did not require City funds. Funding for addendum number one is available in the 2025 Adopted Engineering - Major Streets Capital Budget (Munis #15034). No additional appropriation is required.

WHEREAS, on July 12, 2022, the developer, Saturday Zor Shrine, LLC, hereinafter the “Developer” had entered into a Contract For the Construction of Public Improvements that will be Accepted by the City of Madison hereinafter the “Contract” with the City of Madison, and;
WHEREAS, the Developer and the City have since mutually agreed to add Section 'HH' to the supplemental conditions of the contract, allowing for reimbursement up to the statutory limit of $25,000.00 from the City Sanitary Utility for the off-site sanitary sewer upgrade on West Towne Way, adjacent to Lot 2.
WHEREAS, the Developer shall complete a New Vendor Form and related W-9 form to allow for the City to reimburse the developer for this work.
NOW, THEREFORE, BE IT RESOLVE:
1. That the Mayor and City Clerk are hereby authorized and directed to execute Addendum No. 9088 to 575 Zor Shrine Place, Contract No. 9088, with Saturday Zor Shrine, LLC.
2. That the revised plans and specifications for the public improvements necessary to serve this project are hereby approved.
3. That the developer is authorized to construct the public improvements in accordance with the terms of the Contract For the Construction of Public Improvements That Will be Accepted by the City of Madison at the sole cost of the developer.
