Repealing and recreating Section 28.132(2)(f) of the Madison General Ordinances to prohibit egress wells from projecting into the sideyard setback area on any plat approved after October 1, 1994.

DRAFTER'S ANALYSIS: This ordinance prevents egress wells from projecting into the sideyard setback on any zoning lot platted after October 1, 1994.

The Common Council of the City of Madison do hereby ordain as follows:
Subdivision (f) of Subsection (2) entitled “Other Encroachment Requirements” of Section 28.132 entitled “Encroachments Into Setback Areas” of the Madison General Ordinances is repealed and recreated to read as follows:
“(f) For zoning lots located on plats approved before October 1, 1994, the lowest point of the top edge of any egress well projecting into the sideyard setback area shall be at least six (6) inches above the adjoining grade. For zoning lots on plats approved after October 1, 1994, no egress well may project into the sideyard setback area.”
EDITOR’S NOTE:
Sec. 28.132(2)(f) currently reads as follows:
“(f) For egress window wells that project into the sideyard setback area, the lowest point of the top edge of the egress well shall be at least six (6) inches above the adjoining grade.“
