Body
WHEREAS, on July 28, 2005, the Developer, Starkweather Square, LLC, entered into a Contact For Subdivision Improvements for First Addition to Nelsons Addition to Rustic Acres, with the City, and,
 
WHEREAS, prior to the release of building permits for Lots 33, 34 and 35, individual site plans indicating that the grading of said lots conforms to the approved plan for lot corner elevations, shall be submitted to the City Engineer for approval, and,
 
WHEREAS, the developer shall maintain surety in the amount of $2,500 per lot until said site plans have been approved by the City Engineer.  
 
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are hereby authorized to execute Addendum No. 1 to the Contract for Subdivision Improvements for First Addition to Nelsons Addition to Rustic Acres, Contract No. 2042, with Starkweather Square, LLC.
