SUBSTITUTE Amending Section 9.13(6)(l)1.d. of the Madison General Ordinances to change the time that Saturday-only Mall/Concourse food carts may be parked in their assigned vending sites.

DRAFTER'S ANALYSIS: The hours for most vending in the State Street Mall/Capitol Concourse vending area are 5:00 a.m. to 1 a.m. Under current law, all vending equipment, including food carts, must be removed after these hours. This ordinance amendment would allow Saturday-only food vendors to place their food carts in their assigned sites early (beginning at 12:00 a.m.) during the farmers market season (mid-April to mid-November) so as to minimize traffic congestion on Saturday mornings.
There is a companion resolution, Legistar #36809, to this ordinance and both should be acted upon at the same time.

The Common Council of the City of Madison do hereby ordain as follows:
Subparagraph d. of Paragraph 1. entitled "Hours" of Subdivision (l) entitled "Miscellaneous Vending Restrictions" of Subsection (6) entitled "Regulations and Procedures for Vending on the State Street Mall/Capitol Concourse" of Section 9.13 entitled "License for Selling on Public Streets" of the Madison General Ordinances is amended to read as follows:
"d. All vending equipment (including sidewalk cafés licensed under this section) shall be completely removed during the hours in which vending is not permitted, except that sidewalk café equipment shall be removed no later than thirty (30) minutes after the establishment closes, and Mall/Concourse Food Vendors with Saturday-only assigned food vending sites may park and leave food carts securely locked and unattended in the assigned sites between 12:00 a.m. and 5:00 a.m. on Saturdays only, from the third Saturday in April through the second Saturday in November."
