Amending Section 28. 151 of the Madison General Ordinances to clarify that any change in a limited production and processing use requires a conditional use alteration.

DRAFTER'S ANALYSIS: Limited Production and Processing, as defined by Sec. 28.211 and regulated under Sec. 28.151, requires conditional use approval in districts where it is allowed. This amendment to Sec. 28.151 clarifies that any change in use, either through changing the product being produced or the intensity with which the product is produced and processed, requires a conditional use alteration pursuant to Sec. 28.183(8). This will ensure that the use won’t change from the production of one item to another, or from one production level to another, without taking into account the impact the change might have on the neighborhood.

The Common Council of the City of Madison do hereby ordain as follows:
Subsection entitled “Limited Production and Processing” of Section 28.151 entitled "Applicability” of Subchapter 28J: Supplemental Regulations of the Madison General Ordinances is amended by amending herein the following:
“Limited Production and Processing. All such uses shall be compatible with adjacent nonindustrial uses and be accompanied by a retail component. Any change in the use, either through changing the product being produced or the intensity with which the product is produced and processed, requires a conditional use alteration pursuant to Sec. 28.183(8).”
