Title

Accepting a Public Storm Sewer Easement from Marty Century Farm Family Limited Partnership across lands located in Verona Township.

Body

WHEREAS, the City's Storm Water Utility requires the use for public storm sewer purposes of private lands located in Verona Township owned by Marty Century Farm Family Limited Partnership (the "Owner"); and

WHEREAS, the Owner has offered a Public Storm Sewer Easement to the City of Madison at no cost; and

WHEREAS, City of Madison Engineering Division staff have reviewed and recommend the acceptance of the Public Storm Sewer Easement.

NOW, THEREFORE, BE IT RESOLVED that the City of Madison is hereby authorized to accept from Marty Century Farm Family Limited Partnership, at no cost to the City of Madison, a permanent Public Storm Sewer Easement ("PLE") over the "PLE Area," together with a temporary limited easement ("TLE") for construction, sloping and grading purposes over the "TLE Area," all as described on attached Exhibit A and depicted on attached Exhibit B.

BE IT FURTHER RESOLVED that The TLE shall terminate upon (a) completion of the construction of the storm sewer facilities and final grading of the PLE and TLE Areas; or (b) December 31, 2007, whichever occurs first.
