DRAFTER'S ANALYSIS: Newly enacted Wis. Stat. § 349.03(5) provides that a city may enter into a written agreement with the owner of a private road or driveway within a manufactured and mobile home community to enforce Wis. Stat. ch. 346 traffic regulations on the roads within that community. After the passage of this law, the owners of the Highland Manor manufactured home community (“Highland Manor”) asked the City of Madison Police Department (“MPD”) to enter into a traffic enforcement agreement. Highland Manor includes over 1,000 residents, 360 homes, 9 roads, and 2 playgrounds. The owners of Highland Manor have stated that speeding is a major concern in their community.
If MPD entered into an agreement with Highland Manor at the present time, the speed limit within that community would be 25 miles per hour, as established by Wis. Stat. § 346.57(4)(e). However, a recent traffic and engineering investigation conducted by the City of Madison determined that 25 miles per hour is not a reasonable or safe speed limit there. Instead, it determined that 15 miles per hour is reasonable and safe.
Wis. Stat. § 349.11 allows local governments to increase or decrease state provided speed limits deemed unsafe by a traffic and safety investigation. Using this authority, and the traffic and safety investigation recently completed by the City of Madison, this newly created MGO subsection will establish a speed limit of 15 mph for the roads located within Highland Manor.
