Title

Authorizing the Mayor and the City Clerk to execute a Release of Public Storm and Sanitary Sewer Easement pertaining to a property located at 5739 Tokay Boulevard.

Body

WHEREAS, Tokay Investments Inc (Don Miller) are constructing a new Fiat dealership at 5739 and 5751 Tokay Blvd.;

WHEREAS, the City of Madison Engineers, following a review of the Site Plan, recommend the release of an existing Storm and Sanitary Easement as recorded in Document No. 1178997, pertaining to the property located at 5739 Tokay Boulevard, which no longer accommodates said storm and sanitary purposes;

NOW THERFORE BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute a Release of Easement for the public sanitary and storm sewer easement as recorded in Document No. 1178997, located in the Southwest ¼ of Section 30, Town 7 North, Range 9 East, City of Madison, Dane County, Wisconsin, more particularly described on Exhibit A and depicted on Exhibit B.

BE IT STILL FURTHER RESOLVED, that the Mayor and Clerk are authorized to sign any and all documents and legal instruments required to complete the transactions contemplated in the resolution.
