Fiscal Note
According to the City's Department of Civil Rights, implementation and enforcement of the additional prohibition may require some additional expenditures for print materials, training and education, newspaper notices and related expenses, as well as some potential need for increased staff resources to pursue investigations and process additional caseloads. The magnitude of potential expenditures is currently unknown, but any additional expenditures are currently not provided in the DCR 2007 Executive Operating Budget.

DRAFTER'S ANALYSIS: The ordinance expands the prohibition against discrimination in housing based on the tenant's source of income to include income from the Federal Section 8Housing Program. This proposal is the same as the ordinance adopted by the Dane County Board of Supervisors in September, 2006.

The Common Council of the City of Madison do hereby ordain as follows:

Subdivision (a) of Subsection (4) entitled "Housing" of Section 3.23 entitled "Equal Opportunities Ordinance" of the Madison General Ordinances is amended to read as follows:

"(a) To refuse to transfer, sell, rent or lease, to refuse to negotiate for the sale, lease, or rental or otherwise to make unavailable, deny or withhold from any person such housing because of sex, race, religion, color, national origin or ancestry, age, handicap/disability, marital status, source of income, including receipt of rental assistance under 24 Code of Federal Regulations Subtitle B, Chapter VIII [the "Section 8" housing program], arrest record or conviction record, less than honorable discharge, physical appearance, sexual orientation, familial status, political b...
