Authorizing a Memorandum Of Understanding between the City of Madison Parks Division and the Madison Water Utility pertaining to the construction and maintenance of a shared driveway over and across portions of North Star Park located at 439 Milky Way (Outlot 43, North Addition to Grandview Commons) and the Water Tower Well #225 property located at 435 Milky Way (Outlot 44, North Addition to Grandview Commons). Body
WHEREAS, the City of Madison Parks Division (“Parks”) maintains the parcel located at 439 Milky Way (Outlot 43, North Addition to Grandview Commons) as North Star Park; and
WHEREAS, the Madison Water Utility (“MWU”) uses the abutting parcel at 435 Milky Way (Outlot 44, North Addition to Grandview Commons) for the operation of Water Tower Well #225; and
WHEREAS, Parks and MWU desire to construct and share a driveway along their common property line to allow access to their respective facilities; and
WHEREAS, Parks and MWU staff have agreed to terms and conditions for a Memorandum of Understanding (MOU) between the two agencies regarding the construction, maintenance and use of the shared driveway.
NOW THEREFORE BE IT RESOLVED that the Parks Superintendent and the MWU General Manager, or their respective designees, are hereby authorized to execute an interagency MOU, and any amendments thereto that may be agreed upon from time-to-time, pertaining to the construction, maintenance and use of the shared driveway on terms consistent with the agreement attached hereto, in a form to be approved by the City Attorney.
