Approving Addendum No. 1 to Eighth Addition to Blackhawk - Phase III, Contract No. 2187. (9^th AD)

Body

WHEREAS, on October 29, 2012, the developer, McKenzie 300 Corporation, hereinafter the "Developer" had entered into a Contract for the Construction of Public Improvements that will be Accepted by the City of Madison for Eighth Addition to Blackhawk - Phase III, hereinafter the "Contract" with the City of Madison, and;

WHEREAS, The Developer is seeking approval of a 2 lot  Certified Survey Map to combine Lots 466 - 472 and to vacate River Birch Court with related resolutions RES-12-00950 and RES-12-00928, respectively, and:

WHEREAS, The Developer will need to modify the public improvements necessary for this subdivision to vacate River Birch Court, requiring additional design fees and surety.

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are hereby authorized and directed to execute Addendum No. 1 for Eighth Addition to Blackhawk - Phase III, Contract No. 2187, with McKenzie 300 Corporation.
