WHEREAS, a complaint was filed by Assistant City Attorney Jennifer Zilavy alleging multiple counts of alcohol beverage violations at the premises known as the Bluefin located at 1291 N. Sherman Avenue, Madison, Wisconsin, and

WHEREAS, pursuant to Sec. 38.10 of the Madison General Ordinances, Assistant City Attorney Jennifer Zilavy and Bobby H.H. Lee, Agent, through his attorney, Rick Petri, entered into a stipulation regarding disposition of the subject complaint. The disposition includes a ten (10) day suspension of Imperial Palace, d/b/a Bluefin's Class B Combination Alcohol Beverage license. There was also a municipal court action in which Bobby Lee pled "no contest" to ten (10) counts of liquor law violations and agreed to pay a forfeiture of $1,900.00. The municipal court action resulted in the assessment of 325 demerit points against Bluefin's license.

WHEREAS, the Alcohol License Review Committee (ALRC) recommended approval of the ten (10) day suspension of Bluefin's Class B Combination alcohol beverage license and the terms of the proposed stipulation. The parties stipulated to a suspension period beginning at 8:00 a.m. on February 4th, 2005 and ending at 8:00 a.m. on February 14, 2005.

WHEREAS, the ALRC recommended approval of the parties' agreement that during the period of suspension Bluefin will be able to operate its take-out food operation and its food cart operation

NOW THEREFORE, BE IT RESOLVED, that the Common Council accepts the stipulation of the parties and the recommendation of the Alcohol License Review Committee and hereby suspends the alcohol beverage license granted to Imperial Place, for the premises known as the Bluefin, beginning on February 4th, 2005 at 8:00 a.m. and ending on February ...
