Fiscal Note

Private Contract, No City Funds Required.

Title

Approving future phase contract for public improvements necessary for the Subdivision known as Hawks Ridge Subdivision, Private Contract No. 2129.  (1st AD)

Body

WHEREAS, the developer, Keuler Constrution, Inc., has received the City of Madison's approval to create the subdivision known as Hawks Ridge; and,

WHEREAS, Section 16.23(9) of the Madison General Ordinances requires the developer to install the public improvements necessary to serve the subdivision.

WHEREAS, the Developer wishes to execute a future phase subdivision contract with will allow

the recording of the plat, and,

WHEREAS, a condition of approval of the future phase development the Developer is required to

execute a deed restriction restricting the sale or transfer of all lots in the plat.  

NOW, THEREFORE, BE IT RESOLVED:

1.      That the Mayor and City Clerk are hereby authorized and directed to execute a  Future Phase Contract for the Construction of Public Improvements that will be accepted by the City of Madison for Hawks Ridge Subdivision with Keuler Construction.
