SUBSTITUTE - Accepting a 15-foot wide Public Sanitary Sewer Easement from the Vedders-Shults Trust and the Twesme Trust across property located at 5108 5106 Spring Court.
Body
WHEREAS, the sanitary sewer that exists across the property located at 5108 5106 Spring Court was installed circa 1938 when the property was located in the Town of Madison; and
WHEREAS, the City of Madison Engineering Division requires and has requested a 15-foot wide easement across the property for the sanitary sewer; and
WHEREAS, owners, seller and buyer, recognize that the buildings existing on the property will encroach onto the easement area; and
WHEREAS, the the Vedders-Shults Trust, being the owner and seller of the property, and the Twesme Trust, being the buyer of the property desire to provide the 15-foot easement for the existing sanitary sewer and agree to provide such easement to the City of Madison, at no cost to the City; and
WHEREAS, the City of Madison Engineering Division staff have reviewed and recommend acceptance of the Easement,
NOW, THEREFORE, BE IT RESOLVED, that the City of Madison is hereby authorized to accept from the Vedders-Shults Trust and the Twesme Trust, at no cost to the City, a 15-foot wide Sanitary Sewer Easement across lands described as follows:
A 15-foot wide Sanitary Sewer Easement across Lot 35, Block 1, Spring Harbor, City of Madison, Dane County, Wisconsin, described as follows:
Commencing at the southwestern corner of said Lot 35;
Thence N25º31'31"E along the western property line of said Lot 35, 55.05 feet to the point of beginning;
Thence continuing N25º31'31"E along said western property line, 15.20 feet;
Thence S73º50'01"E, 44.28 feet to appoint on the eastern property line of said Lot 35;
Thence S26º14'37"W along said eastern line, 15.24 feet; thence N73º50'01"W, 44.09 feet to the point of beginning.
This easement contains 662 square feet.
