SUBSTITUTE - Amending Section 9.13(6)(l)2.b. of the Madison General Ordinances to allow the use of generators to run equipment at vending sites in the 700 and 800 blocks of State Street, as an emergency back-up source of energy only.

DRAFTER'S ANALYSIS: This ordinance creates an exception to the prohibition against using generators at food vending sites in the 700 and 800 blocks of State Street (Library Mall). The exception will only allow generators to be used as emergency back-up power when regular power is lost. Otherwise, generators will remain prohibited at that location.

The Common Council of the City of Madison do hereby ordain as follows:
Subparagraph b. of Paragraph 2. entitled "Use of Electricity" of Subdivision (l) entitled "Miscellaneous Vending Restrictions" of Subsection (6) entitled "Regulations and Procedures for Vending on the State Street Mall/Capitol Concourse" of Section 9.13 entitled "License for Selling on Public Streets" of the Madison General Ordinances is amended to read as follows:
"b. The use of generators to run equipment at vending sites located in the 700 and 800 blocks of the State Street Mall is strictly prohibited, except as a back-up energy source for a vendor at an assigned electrical site, on a short-term basis when necessary in case of an emergency or sudden loss of power."
