AMENDED: Creating Subdivision 8.35(3)(f) of the Madison General Ordinances to allow for construction and change in the legal status of certain lands associated with the Madison LakeWay Project.

DRAFTER’S ANALYSIS:    This ordinance would create an exception to the preservation of shoreline parks ordinance to allow the City to proceed with the Madison LakeWay Project in Olin Park (northwest of Wingra Creek), along the John Nolen causeway, and in Brittingham and Law Parks. Under the ordinance, any change in the legal status of, or major construction in, a shoreline park must be approved by City-wide referendum. The Madison LakeWay Project is a major project that, by the time of its construction, will have been the subject of years of planning and public discussions. Exempting this project from the ordinance will allow implementation of the Master Plan to proceed without the need of a referendum.

 

The AMENDMENT further defines and restricts the project scope and area that may proceed without the need for a referendum.

The Common Council of the City of Madison do hereby ordain as follows:

 

                     1.                     Subdivision (f) of Subsection (3) entitled “Exceptions” of Section 8.35 entitled “Preservation of Shoreline Parks” of the Madison General Ordinances is created as follows:

 

“(f)                     Any construction in or change in the legal status of Olin Park northwest of Wingra Creek north of East Lakeside Street, along the John Nolen Drive causeway, in Brittingham Park east of South Bedford Street, and in Law Park south of South Broom Street that is associated with Phase 1 of the Madison LakeWay Project and bike path and pedestrian improvements associated with the John Nolen Drive reconstruction project.”
