PREAMBLE

The Common Council awarded Contract No. 5826, Restoration/Landscaping - 2005 to Greener Valley Landscaping, Inc. on 5/3/05 (RES-05-00411, ID #01028).  Notice of award was sent on May 12, 2005, and the contractor has failed to make a good faith effort to fully execute the contract in a timely manner. Section103.4 of the Standard Specifications for Public Works Construction provides for annulment of the award including forfeiture of bid deposit when the successful bidder fails to fully execute the contract.
