Creating Subdivision 8.35(3)(e) of the Madison General Ordinances to allow the change in legal status of certain lands at Spring Harbor Beach Park. (District 19)

DRAFTER’S ANALYSIS: This ordinance would create an exception to the preservation of shoreline parks ordinance to allow the City to resolve a minor boundary issue with the adjoining property owner at Spring Harbor Beach Park at 1918 Norman Way. Under the ordinance, any change in the legal status of, or major construction in, a shoreline park must be approved by City-wide referendum. In 1954, several years prior to the City acquiring the Park, the Town of Madison granted the adjoining property owner an access easement over the park land that effectively cut off a small portion of the park from the rest of the parcel and created a long-standing boundary issue. With the completion of Phase 3 of the Lake Mendota Drive Project and the replacement of the Norman Way surface, the City sought to resolve this boundary issue with the adjoining property owner. The City and the adjoining property owner have reached a resolution of the boundary issues pertaining to this small area wherein the property owner will purchase the encumbered park area from the City. This ordinance change is necessary to carry out this settlement in order to allow the City’s transfer of this small encumbered area (776 square feet) to the adjoining property.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subsection (e) of Subsection (3) entitled “Exceptions” of Section 8.35 entitled “Preservation of Shoreline Parks” of the Madison General Ordinances as follows:
“(e) Any change in the legal status of the property located at 1918 Norman Way to resolve boundary disputes with the adjoining property owner.”
